Montana law describe how your Montana property will be divided among your heirs if you die without a written will. The rules on intestate succession are complicated, but generally speaking, the division of your property will depend on who survives you. For example:
- If you are survived only by your spouse: All to your spouse.
- If you are survived only by your spouse and you & your spouse's kids: All to your spouse.
- If you are survived only by your spouse and your parents: Your spouse receives the first $200,000, plus 3⁄4 of the balance. Your parents receive 1⁄4 of balance.
- If you are survived only by your spouse, you & your spouse's kids, and your stepchildren : Your spouse receives the first $150,000 plus 1⁄2 of the balance. Your children receive 1⁄2 of the balance. Stepchildren do not inherit.
